It's hard work keeping up with these guys. The Ohio Department of Education and the INS (immigration services), as well as the Turkish guys "advisor," have a heck of time tracking them down and getting their "job descriptions" straight. Perhaps that is deliberate tactic and the reason why they move them around so often.
Look at this poor guy's dilemma, he is juggling two jobs at once in different cities. Last we heard he was the "Director" at Cleveland Middle School and now it is rumored that he is the Director in Cincinnati. But according to the Ohio Department of Education -- there is "no assignment" for him -- it looks like he is lost in immigration cyberspace somewhere.
Sure hope he let the INS know where he went, but that's okay if he didn't -- we'll let them know -- just in case he is busy moving again.
And make sure you note that part where the "DOL" (Department of Labor) is suspicious -- (gee maybe it's about time).

Re: Evidence Needed to Rebut the Intent to Deny Ugur Zengince’s Employment Certification (check with Mustafa Namli’s internal notice posting—they may have been switched)
What we need from Ugur:
(1) A sworn affidavit from Ugur attesting to the date he first began working at H.S.A. and received the job offered (continuing to the present date) he has been legally able and available to perform the duties of the job offered,
(The ETA from 750 said Ugur began working at H.S.A. Columbus on January 2001), but his H1B status was not effective until November 14, 2001 (which would mean he was working unlawfully on an F-1 visa); AND
(2) Documentation that Ugur had a valid teaching license from the State of Ohio Department of Education authorizing him to teach in Ohio schools from the date that he began teaching at H.S.A. (The copy we have is a teaching license that is valid beginning July 1, 2002, but if he began working at H.S.A. in 2001, he’ll need to show that he did have a valid license to teach in Ohio from 2001)
What we need from Horizon Science Academy, Columbus:
(3) Documentation to substantiate Ugur’s work history which must include but is not necessarily limited to:
i. Photocopies of federal W-2 Wage and Tax Statements and/or forms 1099 “Miscellaneous Income” issued by the employer to Ugur for 2001-2006 AND
ii. Photocopies of any required quarterly wage reports to the State of Ohio that reported wages for purposes of unemployment insurance contributions paid by H.S.A. on behalf of Ugur from January, 2001 to the present date AND
iii. Photocopies of paychecks and/or business records and/or business banking records showing any and all wages and/or compensation H.S.A. paid to Ugur from Jan. 1, 2001 to the present date AND
iv. A photocopy of Ugur’s initial contract for employment with H.S.A. showing the date of execution AND
v. Photocopies of the employer’s business records showing the dates and amounts of any and all contributions from the employer paid on behalf of Ugur into the State of Ohio’s state pension fund system AND
(4) Complete documentation of H.S.A.’s initial effort to recruit U.S. workers for the job offered of “H.S. Mathematics Teacher” which must include documentation of H.S.A.’s internal posting of the job opportunity and a fully detailed recruitment report containing all the required information and photocopies of any and all resumes received by H.S.A. in response to its initial recruitment efforts (the advertisements we submitted described the position as that of a ‘Network Administrator’ instead of a ‘Mathematics Teacher’). AND
(5) Documentation to show that either the job offered existed prior to the offer to the Ugur, or, in the alternative, that the job offered is being created solely due to a change in the employer’s business that occurred during the six months immediately preceding or concurrently with the filing date of Ugur’s application that (a) necessitated the addition of a new full-time, permanent position to teach mathematics for grade 7-12; and (b) provided a volume of work available to support a full-time, permanent job opportunity in the occupation of the job offered and performing the duties of the job offered in the area of intended employment of the alien for the wage/salary offered by the employer.
[The DOL was suspicious that the website for H.S.A. Columbus did not list Ugur as one of the three ‘Mathematics Teachers’ there. It appears to them that H.S.A. created the position specifically for him, not because of the actual demand for more teachers. They compared the overall enrollment at H.S.A. Columbus from 2006 with the lower enrollment for 2004. In 2006, there was an average of 150 ‘upper level’ students per math teacher (which means that with six periods in the day, each class would have about 25 students). They claim that because the student enrollment in 2004 was much lower than 2006, it does not appear that there would have been much demand for another math teacher, nor is there evidence that Ugur’s position existed before H.S.A. offered it to him].
Any amendments in part A must be initialed and dated by the employer, and any amendments to part B must be initialed and dated by Ugur.
The Department of Labor has stated: “The burden of proof in all labor certification applications is upon the employer. A written assertion lacking in any supporting reasoning or evidence, while constituting evidence that must be considered, is generally insufficient to carry an employer’s burden of proof.
