These Guys Must Be Ready to have Nervous Breakdowns
Refresher Course:
Sagnak is the guy who was the Director/Dean of Acdemics/Science Teacher (it's exhausting just thinking about all his jobs), and Akayya is the other guy who is/was allegedly -- the Science Department Head (although, I think he has another position now).
Make sure you look at how they ask about "Mr. Zen's" application (remember -- he's the guy that is essentially "missing" from the ODE website -- see Oh! Where or Where Did He Go?).
Both guys had been turned down previously for green cards and needed to do some "fancy" footwork in order to get reconsidered and ultimately sponsored.
And who says our government isn't sharp? You got to give it to Homeland Security -- they just keep giving them green cards. That makes us feel "secure," how about you?
By the way -- before you guys try to say that this is "all made up," we all know that it is true and can be documented -- so don't waste your breath or our time rebutting it.
(See Identity Crisis for Sagnak & Akkaya's ongoing saga).
MEMORANDUM

Date: August 2, 2007
Re: Evidence Needed to Rebut the Intent to Deny Murat Sagnak’s Employment Certification
What we need from Murat:
(1) A sworn affidavit from the beneficiary alien (Murat) attesting to the date he first began working at H.S.A. and received the job offered, that on that date he possessed the legal authority (ability) to work in the United States, and that he had a valid license from the Ohio Department of Education to teach in Ohio
(Murat stated that he had worked at H.S.A. beginning 2001 on his resume and this is what we put on the ETA from 750 –but this was before he had H1B status—He must initial and date any changes to the ETA form 750 part B)
What we need from Horizon Science Academy:
(2) That from the date Murat began working at H.S.A., he possessed all the minimum requirements of the job offered, AND
(3) Documentation to substantiate Murat’s work history which must include:
i. Photocopies of federal W-2 Wage and Tax Statements and/or forms 1099 issued by the employer to Murat for 2001-2006 AND
ii. Photocopies of any required quarterly wage reports to the State of Ohio that reported wages from H.S.A. paid to Murat from 2001 to the present date AND
iii. Photocopies of paychecks and/or corporate payroll records showing any and all wages and/or compensation H.S.A. paid to Murat from 2001 to the present date AND
(4) Documentation to show that U.S. Workers applying for the job opportunity were rejected solely for lawful job related reasons; AND
(5) Any changes to the ETA Form 750 Part A should be corrected (specifically check the dates stating when Murat began teaching at H.S.A. Any amendments in part A must be initialed and dated by the employer)
The Department of Labor has stated: “The burden of proof in all labor certification applications is upon the employer. A written assertion lacking in any supporting reasoning or evidence, while constituting evidence that must be considered, is generally insufficient to carry an employer’s burden of proof.

Subject: RE: Job description for Mr. Akkaya
Hello Mr. Sagnak and Mr. Akkaya:
Here is the job description. Please look it over before using it for recruitment purposes. I underlined some things that were not stated in your job description but I added because I thought that you might have overlooked them. Also, I just wanted to make sure that the positions are for Denison (Grade 4th to 8th??) because both of you sent me two different job descriptions with different grades.
Please discard Mr. akkaya's job description, he is going to apply from Denison and we have 4 thru 8 here.
Also, in terms of job requirements, do you require a minimum of 2 years of experience or 5 years?
I think 2 year is fine.
Again, both of your descriptions do not correlate. I just want to clarify that in order to apply for an EB-2 petition, the job has to require a minimum of 5 years of progressive work experience or Masters Degree. In order to pass this test, everyone holding similar positions should have the same background in terms of experience and degree; otherwise, there could be a denial.
We both have 5-year of experience in the US and more than 10 years of total. We are also pursuing master at Cleveland State University.
Can we add "doing home visits" and " prepare students for the Ohio Achievement Test" to the duties?
Also, since asking for 5 years of experience for a teacher is not typical, the USCIS looks at the application very carefully to make sure that recruitment is not unduly restrictive of US candidates. For that same reason I changed the wording from requiring a license to having the minimum requirments for licensure since that is typically what the CIS wants. Please get back to me with any changes. If you have any questions, let me know. Thanks.

Hi Mr. Sagnak,
Here's the things that I believe should be changed on your documents.
1) the Teacher license is until 6/30/08. Can you extend it? If not, we might just get approval until that time frame.
I believe this is my alternative administrator license. As it's stated in the license, it can be renewed two more time for next ywo years. I can not extend it now. Approval for that time (6/30/08) will shorten my visa and jeportize my one year time period between PERM application and the visa extension application in January 2009. I'm not sure if we should do that.
2) Employment contract --should be from 12/1/ 07. The references should be to Director or Director/Teacher. The teacher responsibilities should reflect those of a director/teacher.
Maybe I should eliminate the teacher part. How was Mr. Zen's?
4) Job offer--Salary consistent with contract. Responsibilities should be consistent with director/teacher, if that is what the position is. Right now it only lists director duties.
Again I'm not sure if we should make it director only or director/teacher.
5) Resume--Should be in reverse chronological order, should list principal license, director position technically can only begin after you file H-1B paperwork, so list all similar responsibilities.
What if we do it as acting director?
